Criminal Law
Criminal law has been one of the main branches of law practiced by our firm since its inception. Mainly the founding partner Dr. Jose’ Herrera has undertaken a number of major criminal cases and trials by jury. Today the firm continues to work in this field.
Civil Law
Civil law is of great importance in Maltese society and our firm takes this area of Maltese law very seriously. The firm has undertaken a number of cases on property rights, debt collection and contract law amongst others.
Family Law
Family law is also a very important field in Malta. Recent legislative changes including the introduction of divorce has made it indispensable for an established law firm to be a leader in this field. This is also a major part our work.
Administrative Law
A very important function of the law courts in any democracy is the power to review administrative decisions. In Maltese law there are two main actions that one can pursue in this field. The first is judicial proceedings in the ordinary courts requesting judicial review. The second is having recourse to the Administrative Review Tribunal which was set up a few years ago. This tribunal is chaired by a magistrate and acts as an appeal court for many administrative decisions.
Constitutional Law
A number of landmark cases have been attempted successfully by our firm in this field. In the past a number of requisition orders were issued following which the owners were never fully compensated. This has led to a number of constitutional cases requesting compensation. Our firm has also been a leader in the development of case-law in Malta relating to identity documents of trans gender persons. A number of cases we presented eventually led to a law setting up a simpler procedure of amending one’s identity documents. Other cases involved the right to a fair hearing.
Our law firm also represented a number of clients in the European Court of Fundamental Human Rights in Strasbourg.
Litigation & Dispute Resolution
Our firm handles court duties daily, ranging from criminal proceedings following simple arguments to civil cases involving substantial sums of money. We also handle mediations mostly in the field of family law.
Corporate and Commercial Law
Commercial law is also a main branch of our activity. Company formation is also undertaken by the firm.
Drafting and Review of agreements
Following a dispute resolution one must put down such agreement in writing. Besides in the complex modern society it is important that people and companies regulate their relations by simple and yet water-tight agreements and contracts.
Citizenship and Residence Programmes
Malta is strategically located in the Mediterranean, part of Europe but close to North Africa and the Middle East. It is a member of the European Union and the Eurozone, and boasts excellent relations with its neighbours.
